Official Rules

The Weekly MyDigitalStudio.net Challenge and Giveaway is designed to recognize our creative and talented My Digital Studio users.

• NO PURCHASE NECESSARY.
• APPLICATION IS OPEN TO RESIDENTS OF THE UNITED STATES, CANADA (EXCLUDING QUEBEC), AUSTRALIA, AND NEW ZEALAND.
• THIS OPPORTUNITY IS NOT BEING OFFERED IN QUEBEC, AND THE US VIRGIN ISLANDS AND WHERE PROHIBITED BY LAW.
• THIS OPPORTUNITY MAY BE RESTRICTED ON US MILITARY INSTALLATIONS OVERSEAS.
• ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS APPLY.
• APPLICANTS MUST BE 18 YEARS OF AGE OR OLDER (19 OR OLDER IN ALABAMA AND NEBRASKA; 21 OR OLDER IN MISSISSIPPI) TO PARTICIPATE.

1. Eligibility

• All past Weekly MyDigitalStudio.net Challenge and Giveaway winners ARE eligible to participate in each and every future challenge.
• Employees, officers, and directors of Stampin’ Up!, its suppliers, and their respective parent and affiliate companies and advertising and promotion agencies, as well as members of their immediate families (spouses, parents, siblings and children, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate.

2. Submission Period and Requirements

The Weekly MyDigitalStudio.net Challenge and Giveaway period begins September 1, 2012 and ends on December 28, 2013. Entries for each challenge must be submitted by or before 12:00 PM noon (MT) on Friday. Late entries will not be considered for the Weekly MyDigitalStudio.net Challenge and Giveaway.

• Submission components must be submitted electronically via the Samples section on MyDigitalStudio.net.
• All hybrid submissions must use current Stampin' Up! products only. This includes all products available for sale by Stampin' Up! during the entry timeframe. However, three-dimensional items may use items such as frames, boxes, etc. that are not available from Stampin' Up!
• All submission items tagged with the specific text given in each week’s challenge blog post on MyDigitalStudio.net will be given preference in judging.
• Submissions cannot be copyrighted.
• Submissions should not include photos taken by professional photographers unless you have obtained a release of the copyright in writing.

3. Judging

• Members of the My Digital Studio team will review and select samples each Friday before announcing winners in the Saturday MyDigitalStudio.net blog post.
• Challenge winners will be chosen based on the creativity and style, craftsmanship, composition, color, and consistency of their entries.
• Stampin’ Up!’s decisions regarding Weekly MyDigitalstudio.net Challenge and Giveaway winners are final.

4. Recognition and Compensation

• The selected Weekly MyDigitalStudio.net Challenge and Giveaway winner will be announced in each Saturday MyDigitalStudio.net blog post. Each winner will receive one (1) free Digital Download from the following Tuesday’s new downloads, ranging in value from $0.95 to $34.50.
• Compensation (including product) is non-transferable and no substitution will be made unless Stampin’ Up!, in its sole discretion, determines otherwise.
• Taxes are the sole responsibility of the Weekly MyDigitalStudio.net Challenge and Giveaway winner.

5. Miscellaneous

Limitation of Liability

By participating in the Weekly MyDigitalStudio.net Challenge and Giveaway, all participants agree to release, discharge, and hold harmless Stampin’ Up! and its suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective officers, directors, employees, and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Weekly MyDigitalStudio.net Challenge and Giveaway or receipt or use or misuse of any prize. Additionally, all applicants agree to indemnify, release, discharge, and hold harmless the Released Parties from and against any claim or cause of action brought against any of the Released Parties as a result of an applicant’s breach of these Application Process Official Rules, including without limitation any breach of a third party's intellectual property rights.

Stampin’ Up! assumes no responsibility for any of the following in connection with the Application Process: any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Application Process or votes; or alteration of applications, submissions, or votes. Stampin’ Up! is further not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail entry or vote to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or fraud by any applicant.

Conditions

To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Weekly MyDigitalStudio.net Challenge and Giveaway are hereby excluded and any applicant expressly waives any and all such rights. Certain restrictions may apply in some jurisdictions.

Applications void if Stampin’ Up! determines the submission to not be an original, or if the submissions are incomplete, in the wrong shape or size, or obtained through fraud or theft or otherwise non-compliant with these Official Rules.

By participating, applicants also agree (a) to be bound by these Official Rules; and (b) that the decisions of the Stampin’ Up! are final and binding with respect to all matters relating to the Weekly MyDigitalStudio.net Challenge and Giveaway.

The Stampin’ Up! reserves the right to verify the validity and originality of any submission and/or entrant (including an applicant’s identity and address) and to disqualify any applicant who presents a submission that is not in accordance with these Official Rules or who tampers with the Application Process. Failure by the Stampin’ Up! to enforce any of its rights at any stage does not constitute a waiver of those rights.

Right to Cancel or Suspend Opportunity

If for any reason this Opportunity is not capable of running as planned, due to infection by computer virus, bugs, worms, Trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Stampin’ Up! that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Weekly MyDigitalStudio.net Challenge and Giveaway, Stampin’ Up! reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Application Process. In such event, compensation will not be awarded. If Stampin’ Up! elects to cancel or terminate the Weekly MyDigitalStudio.net Challenge and Giveaway under any of the circumstances described above, Stampin’ Up! will not retain any rights to the submitted applications.

Data Privacy

By applying, applicants agree that personal data, including without limitation name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Opportunity and any other purposes outlined in these Official Rules. The data may also be used by Stampin’ Up! in order to verify the participant's identity, postal address, and telephone number or to otherwise verify the participant's eligibility to participate in the Weekly MyDigitalStudio.net Challenge and Giveaway.

Use of Submissions

Application to Stampin' Up! constitutes an agreement with the Weekly MyDigitalStudio.net Challenge and Giveaway rules and acknowledgement that Stampin' Up! reserves the right to use the artwork as desired. Submission of a sample and/or acceptance of an award grants Stampin' Up! the right to publish, use, edit, adapt, and/or modify winning submissions in any way without territorial, time, use of, or any other stipulations for any and all purposes, including but not limited to advertisements, in any and all media worldwide without further compensation to the demonstrator or customer.
